Delegate Michael D. Smigiel,
Sr.
District 36
Total Number of Bills: 166
HB
12
Status as of February 15, 2006: Bill is in the House - First
Reading Judiciary
- Repeal of Procedure on Shell Casing Information - Timing
of Report on Personalized Handgun Technology. (While
the bill did not pass we were successful in eliminating
the funding for this program and transferring the state
police personnel to other more productive duties. )
- House: Judiciary (Heard:
March 8, 2006, 1:00 p.m.)
HB
13
Status as of April 25, 2006: Became Law - Chapter 151
- Law Enforcement Agencies - Prohibition Against Arrest
and Citation Quotas
(This bill was the number 1 priority of the state and
local police unions lobbing efforts in Annapolis last
session.)
- House: Judiciary
Senate: Judicial Proceedings
HB
14
Status as of February 15, 2006: Bill is in the House - First
Reading Judiciary
- Handgun Safety Devices - Repeal
(We will continue to submit this bill until the
legislature acts responsibly and repeals defacto
prohibitions on the second amendment such as this law.)
- House: Judiciary (Heard:
March 8, 2006, 1:00 p.m.)
HB
23
Status as of February 28, 2006: Bill is in the House -
Unfavorable Health and Government Operations
- Public Power of Attorney - Health Care Decisions
(This bill was submitted three years in a row as an
effort to negate the arguments raised for same sex
marriages. Governor Ehrlich's administrative bill
incorporated HB-23's provisions and was passed.)
- House: Health and Government Operations
HB
27
Status as of March 23, 2006: Bill is in the House -
Unfavorable Environmental Matters
- Department of the Environment - Rubble Landfills -
Location
(The senate cross file of this bill was passed resulting
in the protection of Unicorn Lake and its pristine
environment for at least the next three (3) years. We will
continue all efforts to make these protections Permanente.
)
- House: Environmental Matters
HB
33
Status as of February 22, 2006: Bill is in the House - First
Reading Ways and Means
- State Property Tax Exemption - Surviving Spouse of a Law
Enforcement Officer or Rescue Worker
(This is a bill that should be passed our first line
defenders deserve nothing less. While we have been
successful in The House the bill has failed to pass The
Senate.)
- House: Ways and Means (Heard:
March 10, 2006, 1:30 p.m.)
HB
44
Status as of March 22, 2006: Bill is in the House -
Unfavorable Environmental Matters
- Eminent Domain - Condemnation Proceedings and Limitation
on Condemnation Authority
(Eminent Domain should be the primary concern of the
legislature next session.)
- House: Environmental Matters
HB
81
Status as of February 20, 2006: Bill is in the House -
Unfavorable Judiciary
- Criminal Procedure - Media Coverage of Criminal
Proceedings
(Cameras are in our legislature, The State House, on
police cars, and street corners there is no reason to
exclude our courtrooms from public access through new
technology such as tv coverage. I will continue to
resubmit this bill. Though it may be somewhat harder to
find witnesses to speak in favor after the last Judge to
testify in favor of cameras in the courtroom was punished
with a demotion for having testified before The House
Judiciary Committee.)
- House: Judiciary
HB
83
Status as of March 7, 2006: Bill is in the House -
Unfavorable Environmental Matters
- Vehicle Laws - Traffic Control Signal Monitoring Systems
- Repeal
(It has now become clear that "Red light
cameras" are for revenue generation and not safety.
We will continue to address this concern.)
- House: Environmental Matters
HB
84
Status as of May 2, 2006: Became Law - Chapter 421
- Court of Special Appeals - Right of Appeal from Circuit
Court In Banc
(This bill (commonly known as the poor-man's appeal)
passed the House and Senate and will appear on the ballot
this November because it requires a change to the Maryland
State Constitution. )
- House: Judiciary
Senate: Judicial Proceedings
HB
85
Status as of February 28, 2006: Bill is in the House -
Unfavorable Environmental Matters
- Task Force to Create Standards of Ethics for Planning
and Zoning Boards
(This bill was supported by Common Cause and other good
government organizations. We shall resubmit this bill.)
- House: Environmental Matters
HB
217 Status as of
March 27, 2006: Bill is in the House - Withdrawn Judiciary
- Vehicle Laws - Drunk Driving Penalties - License
Suspension Modification or License Restriction -
Additional Qualifying Circumstances
(This bill was incorporated into HB-525 which passed.)
- House: Judiciary
HB
243 Status as of
February 1, 2006: Bill is in the House - First Reading
Health and Government Operations
- Task Force on Indoor Air Quality in Educational
Institutions
(This is an important bill for children, teachers and
others who utilize our public school buildings. As
unbelievable as it sounds Maryland has a mold standard for
industrial sites but none for our schools. Maryland's air
quality team has no equipment or personnel trained to test
for mold. It is unquestionable that there is a serious
problem within many schools throughout the state which
must be addressed.)
- House: Health and Government Operations
(Heard: February 7, 2006, 1:00 p.m.)
HB
483 Status as of
March 6, 2006: Bill is in the House - Unfavorable Ways and
Means

for Agricultural Preservation
(This bill will enlarge the available funds for
agricultural preservation without increasing taxes by
simply allowing those farmers who participate in easement
programs to receive their funds tax free.)
